Cancellation and Refund Policy

At Neo Mark Media, we want you to be completely satisfied with our services. Accordingly, we establish the following cancellation and refund terms:

1. Right of Cancellation

1.1 Full Refund (First Payment Only). The Client may cancel the contracted service without cause within seven (7) calendar days of the first payment made to the Agency and shall be entitled to a full refund of the agency fee portion of that first payment.

1.2 Non-Refundable Items. The refund provided in Section 1.1 applies exclusively to the agency fee. The following third-party costs and pass-through services, once incurred or rendered, are expressly excluded from any refund:

(a) Telephony and call services (VoIP, minutes, virtual numbers);
(b) SMS and messaging services;
(c) Email and transactional email services;
(d) Artificial intelligence usage (APIs, tokens, AI credits);
(e) Advertising spend (ad spend) already deployed on platforms such as Meta, TikTok, Google, or any other media platform charged by our agency;
(f) Any other third-party costs, software subscriptions, or services paid by the Agency on behalf of the Client.

1.3 Unspent Ad Spend. Any advertising budget deposited by the Client and not yet deployed to media platforms at the time of cancellation will be refunded to the Client within fifteen (15) business days, less any payment processing fees actually incurred.

1.4 Cancellation After the First Payment. Once the seven (7) day window in Section 1.1 has expired, or once any payment beyond the first payment has been made, the Client may terminate the service only by providing the Agency with at least thirty (30) calendar days' prior written notice sent to [email protected]. During that 30-day notice period the service will remain active and the Client shall remain responsible for all corresponding payments. No refund of the agency fee shall be issued for any payment made after the first billing cycle.

1.5 Form of Request. All cancellation and refund requests must be submitted in writing to the Agency's official email address. Verbal requests or requests made through any other channel shall not be considered valid.

2. How to Request Cancellation

2.1 Method of Submission. All cancellation requests must be submitted in writing via email to [email protected]. Requests made by phone, WhatsApp, SMS, in-person conversation, or through any account manager or team member outside of the designated email address shall not be considered valid and will not toll or extend any cancellation deadline.

2.2 Deadlines by Scenario. The Client must submit the cancellation request within the applicable window described below:

(a) Full-refund cancellation (first payment). To exercise the right to a full refund of the agency fee under Section 1.1, the request must be received within seven (7) calendar days of the first payment date.

(b) Post first-payment cancellation. To cancel after the initial 7-day window or after any subsequent payment, the request must be received at least thirty (30) calendar days prior to the desired termination date, in accordance with Section 1.4. The service will remain active and billable during that 30-day notice period.

2.3 Subject Line. The subject line of the email must read: "Cancellation Request – [Contract Number or Service Name]". Requests without a proper subject line may experience processing delays, but the date of receipt shall still be the date used to calculate the applicable deadline.

2.4 Confirmation of Receipt. A cancellation request shall be deemed received only when the Agency issues a written acknowledgment of receipt to the Client (auto-replies do not qualify as acknowledgment). If the Client does not receive an acknowledgment within three (3) business days, it is the Client's responsibility to follow up in writing to confirm receipt.

3. Refund Processing

Once we receive and verify your request, we will process the refund within 14 business days.

Refunds will be issued using the same payment method originally used.

4. Work Already Underway

4.1 Deduction of Work Performed. If the Agency has commenced specific onboarding or production work during the seven (7) day refund window described in Section 1.1 — including but not limited to campaign setup, ad account configuration, pixel and tracking installation, creative or asset design, funnel or landing page build-out, CRM or automation setup, copywriting, media buyer onboarding, or strategy sessions — the Agency reserves the right to deduct from the refund the proportional cost of the work completed as of the cancellation date.

4.2 Basis of Calculation. Deductions will be calculated based on the Agency's standard hourly and project rates, or as a proportional share of the agency fee reflecting the percentage of the onboarding scope completed, whichever the Agency reasonably determines applies. The Agency will provide the Client with a written itemization of the work performed and the corresponding deduction within seven (7) business days of the cancellation request.

4.3 Deliverables Ownership. Any deliverables, creatives, funnels, automations, ad accounts, or other assets produced during this period remain the intellectual property of the Agency until the deducted amount is paid in full and shall not be transferred, licensed, or used by the Client if a full refund is issued.

4.4 Dispute of Deduction Amount. The Client may dispute the amount of the deduction in good faith by responding in writing within five (5) business days of receiving the itemization. The Client may not dispute the Agency's right to deduct for work actually performed

5. Exceptions

A full refund will not apply to:

Training or educational services that have been fully delivered.

Purchases of third-party licenses or tools that have already been invoiced.
